Commitment Certificate - Think seven days before welcoming a pet!
Seven days before welcoming into your home a cat, dog, ferret, rabbit… that you wish to buy or adopt, you will now have to sign a “certificate of commitment and knowledge”. This document is intended to inform you about the needs and behavior of your pet, the cost of its maintenance and the obligation to register its identification. The goal is to avoid impulse buying and the churn that sometimes ensues a few months later.
If you wish to adopt a pet, which is given to you free of charge or sold, you must have signed a “certificate of commitment and knowledge” seven days in advance, with a handwritten mention expressly specifying that you will respect the needs of this animal. , according to a decree of July 22, 2022.
In force since 1um October 2022, this text aims to verify that you are aware of the implications of owning a cat, dog, ferret, rabbit, etc. Specification for the animal concerned:
- their daily physiological, behavioral and medical needs;
- the obligations relating to your identification (electronic chip or tattoo);
- the costs and logistical implications (desirable space, outings, babysitting during holidays, etc.) related to the satisfaction of his lifelong needs.
A decree published in Official newspaper of 26 October 2022 sets the amount of sanctions envisaged in the event of non-compliance with this new provision.
Avoid impulse buys and abandonments
Taken in application of the law of November 30, 2021 aimed at combating animal abuse and strengthening the bond between animals and humans, this measure aims to avoid impulse purchases, sometimes followed by abandonment when the obligations and constraints associated with owning a animal, or the mistreatment of the animal out of ignorance of its needs.
If you own an equine (horse, pony, donkey, etc.), this certificate of commitment will be mandatory as of December 31, 2022, regardless of the date of acquisition of your animal.
Who must issue this certificate of commitment?
This certificate is drawn up by a person in possession of the Certificate of Knowledge for Companion Animals of Domestic Species (Acaced) or an equivalent professional certification. This could be a veterinarian, rancher, shelter manager or animal welfare organization. It is not necessarily the person who transfers the animal, especially if it is an individual.
The obligation to present this certificate and to ensure that it has been signed and completed with its handwritten note 7 days before the acquisition rests with the assignor, professional or private. He will be subject to sanctions if he does not comply with it, as well as whoever issues or writes a non-compliant certificate.
The Ministry of Agriculture will indicate the format of this certificate in a forthcoming technical instruction.
Sanctions provided for in the event of non-compliance with the new provisions
They are punished with the pecuniary sanction foreseen for the contraventions of 3And class (€450 maximum):
- the fact of issuing a non-compliant certificate of commitment and knowledge to the future purchaser of a pet;
- the fact of delivering a pet without guaranteeing the prior signature of this certificate by the purchaser. The transfer of the animal must take place 7 days after the issue of the certificate;
- failure to comply with the obligations relating to the publication of online sales offers. These ads must include awareness and information messages and be found in specific sections on classified ad sites.
