10 advances benefiting animals in 2022 in France

Although animals are still too often abused, some progress was made on their behalf in France in 2022, thanks to the support of animal protection NGOs. 30millionsdamis.fr has selected 10 of them.

Creation of the certificate of knowledge, fight against animal abuse, cancellation of cruel hunts… The year 2022 will be marked by some beneficial news for our 30 million friends in France. Overview.

1. A certificate of knowledge required for the acquisition of a pet

From 1um October 2022, Certificate of Commitment and Knowledge required for pet and equine acquisition. Established by the law of 30 November 2021 aimed at combating animal abuse – and clarified by the decree of 18 July 2022 – this new system should make it possible to avoid abuses related to compulsive purchases, responsible for thousands of abandonments every year. To promote responsible adoptions, the certificate includes “ a handwritten declaration in which the new purchaser expressly undertakes to respect the animal’s needs “, and specify” physiological, behavioral and medical needs ” of the species considered, as well as ” the obligations relating to the identification of the animal “, or even, “the financial and logistical implications for meeting the needs of that species throughout the life of the animal “. If the 30 Million Friends Foundation has welcomed this new measure, it wants to go further by proposing the creation of a real detention permit that could be refused upon acquisition of an animal – or revoked – to any guilty person of neglect or abuse.

2. The Toulouse Court of Appeal creates a center dedicated to the abuse of animals

A center dedicated to the fight against violence against animals – and against environmental crimes – was set up by the Court of Appeal of Toulouse (31), on the initiative of the Attorney General Franck Rastoul. Active since 1 September 2022, this center helps improve the judicial response to cases of animal abuse. The structure also provides for the training of the magistrates of the Court of Appeal. These educational actions are all the more essential as animal abuse litigation is very technical and magistrates are too little aware of the issue. ” We welcome this initiative, a fortiori because it comes from the magistrates themselves. This is all the more positive as it too often compares itself to the 30 Million Friends Foundation classifications without follow-up in documented animal abuse recordsreacted Reha Hutin, its president. We can therefore only congratulate ourselves for this awareness. It remains to be hoped that other jurisdictions will follow suit. “.

3. The Minister of the Interior establishes a body of specialized investigators

At the end of October 2022, Interior Minister Gérald Darmanin announced the creation of a division of 15 investigators specifically responsible for animal abuse. A decision taken in the face of the increase – of 30% since 2016 – of mistreatment and acts of cruelty towards pets. Although the 30 Million Friends Foundation has welcomed this awareness on the part of the Ministry of the Interior and remains at its disposal to support it, it nevertheless wonders about the methods of application of this provision, for which many questions remain unanswered. What about, in particular, the preliminary training, prerogatives and means of action of the 15 police officers and gendarmes who will be mobilized… to deal with the 12,000 annual cases of animal abuse? The 30 Million Friends Foundation alone relies on a network of 450 volunteer investigators to rescue more than a thousand endangered animals each year!

4. Egg mold ready to finish squashing male chicks

At the beginning of autumn 2022, the interprofession of eggs (CNPO) announced that it was “ready” to put into service, as of December 31, 2022, its egg-assessing machines which will make it possible to determine the sex of embryos in the egg. during the first 14 days, to eliminate the males before they hatch. The ban on the grinding and gassing of male chicks in the laying hens sector, imposed by decree of 5 February 2022, is however affected by derogations which contribute to emptying it of substance. On the one hand, the egg interprofession allegedly managed to obtain, for “European competition reasons”, a derogation for white eggs intended for processing, which represent up to 50% of the total eggs produced in France. The 2022 decree instead provides for an exception for chicks intended for animal feed, whose meat is transformed into croquettes or mash for pets or flour for livestock. Not forgetting the chicks who will continue to be crushed in the meat and foie gras sectors! Reasons why the 30 Million Friends Foundation urges the government to end this unbearable animal suffering, whatever the sector.

5. Air France wants to end the transport of laboratory monkeys

At the end of June 2022, the airline Air France announced that it will stop transporting monkeys to laboratories. Effective from mid-2023, this decision is expected to save thousands of monkeys from the worst suffering every year. The 30 Million Friends Foundation therefore welcomed the initiative but regrets that other animals – fish, reptiles, horses and dogs – continue to be sent to laboratories, in cages, bags or boxes, at the cost of mental and physical injuries. It reiterates its request to the European Commission to put an end to animal testing, when alternative methods exist.

6. Traditional bird trapping – again and again – canceled

At the end of November 2022, the State Council declared the traditional capture of wild birds illegal for the fourth consecutive year, thus saving the lives of over 113,000 animals. Already suspended by the precautionary judge a year earlier – just a few days after their publication – the now canceled decrees authorized, in several departments, for the 2021-2022 hunting season, the capture and destruction of 106,000 larks, 5,800 thrushes and blackbirds as well as 1230 plovers and lapwings, using traditional trapping devices such as pantes, matoles and tenderries. According to the High Administrative Court, these ministerial decrees were incompatible with the European directive “Birds” of 30 November 2009. Firstthe Department has not demonstrated that the techniques used were selective; secondnor did it demonstrate that these methods were the only ones that allowed the capture of the targeted species, while alternatives exist. The 30 Million Friends Foundation welcomes this jurisprudence – now constant – and asks the Ministry of Ecological and Solidarity Transition to draw the necessary conclusions to definitively abolish these practices from another time.

7. Capercaillie hunting prohibited for 5 years

By decree 1um September 2022, the government suspended capercaillie hunting in mainland France. for a period of five years “. This decision was taken by order of the Council of State, to remedy the decline of the species, classified as vulnerable on the French red list of threatened species and present in the Pyrenees, Cévennes and Jura: “ The gravity of the situation of this species in a poor state of conservation makes it necessary, in order to comply with the obligations deriving from the objectives of Directive 2009/147/EC, to refrain from any collection of capercaillie throughout the territory for a rather long periodAnd”.

8. Justice nails bear scare in the Pyrenees

In late 2022, the Council of State, for the third consecutive year, questioned the use of non-lethal shooting to keep brown bears away from herds in the Pyrenees. In particular, the High Administrative Court partially annulled the decree of 31 May 2021 in the part in which it allows prefects to grant the use of enhanced scare measures on brown bears, without however supervising the implementation of this device with females in gestation and in their foals (accompanied by their puppies). In fact, the prefectorial derogations likely to be granted, by virtue of the decree, risk (unlike “simple” measures of fear, sound, smell or light) of jeopardizing the maintenance of the populations concerned in their natural distribution area, and jeopardize the improvement of the status of the species. However, as the administrative judge points out, “ despite the protection regime established in 1981 and the reintroductions carried out since 1996, the conservation status of the species has not regained a favorable character “. According to nature experts, despite the positive development of numbers and despite the stability of the habitat of the species, ” development prospects remain unfavourable “. For this reason, the 30 Million Friends Foundation calls on public decision makers to definitively abandon this dangerous and ineffective measure.

9. Yew digging questioned

In 2022, the administrative courts annulled the prefectural decrees authorizing – for example in the Ardennes or in the Saône-et-Loire – the opening of a further yew resurrection period from mid-May, in other words: four months before the opening hunting general! According to the court decisions, the badgers killed from May to September are still in a situation of dependence on adults and must therefore be protected. Beyond the additional periods, the 30 Million Friends Foundation punishes underground hunting which inflicts unbearable suffering on badgers, violently dragged from their burrows to be slaughtered. Barbara Pompili reiterates her request to purely and simply ban this practice from another time to the Minister for Ecological and Solidarity Transition. Pending this national reform, the 30 Million Friends Foundation is asking all departmental prefects to ban this cruel practice or, at the very least, to waive the additional periods of digging.

10. Fort Boyard Tigers Finally “Retired”

2022 has begun with the “retirement” of Kashmir and Tosca, the two tigers – 5 and 11 years old – exhibited in the “Fort Boyard” program on France 2.
